The latest figures from the Land Registration Court show that 164,371 future power of attorney documents were established in 2025 – an all-time high. At this level, it has become Denmark's most widespread legal document, surpassing both wills and marriage contracts. The numbers also indicate fewer documents are being rejected when put into action.
In a short time, a new legal document has become the most used by Danes.
More and more Danes are choosing to appoint someone to handle their financial, personal, and health matters should they one day lose the ability to make decisions due to illness or an accident. The future power of attorney has quickly become central in the collection of private documents for many Danes.
Explosive Growth in Power of Attorney Documents
The latest statistics reveal that 164,371 Danes set up a future power of attorney in 2025 — the highest since the document was introduced in 2017. It ranks above more familiar documents like wills and marriage contracts.
“The future power of attorney has achieved a special status in record time and is now the preferred legal tool for Danes wanting to ensure their own and their loved ones' safety in critical situations where they cannot manage their own financial, personal or health matters,” explains chief legal officer Katrine Lindgaard Pedersen from the legal advisory firm Replik.
A Legal Document for Everyone
The rapid spread is attributed partly to its appeal to a broad segment of the population. Nowadays, it's not just the elderly considering this document but also ordinary families wanting clarity about who can act on their behalf if they suddenly cannot.
“It's both seniors, people with illnesses, and those in high-risk professions. Increasingly, it's also middle-aged individuals with family, homes, and financial obligations wanting to secure who can act for them,” she says.
Fewer Rejections – But Some Pitfalls Remain
An inquiry at the Family Court, responsible for activating future powers of attorney when needed, shows fewer documents are rejected than before. In 2025, about one in ten were rejected, compared to one in six in 2024 and one in five in 2023.
According to Replik, rejections are often due to known errors in the document.
“We often see permissions given to use the grantor's MitID, which isn’t allowed as MitID is personal. Mistakes also occur when gift provisions aren’t clear. It must specify clearly who can receive gifts, their type, size, and frequency. Without this, the provisions are unusable, making the document invalid,” explains Katrine Lindgaard Pedersen, adding:
“Mistakes can have serious consequences as these documents are often used in critical life situations where the grantor has lost decision-making ability. Errors can create uncertainty and delay crucial decisions about financial and personal matters.”
She emphasizes that the widespread use of the future power of attorney also demands correct completion to ensure the security it provides is truly available when needed.
